Twenty-one, no exceptions

You must be 21 years of age or older to purchase from Above Wines, LLC or Grappolo Wine Shop, in person or online. By placing an order you represent that you are at least 21, and an adult of legal drinking age must sign for every delivery. We refuse any sale, and cancel any order, where age cannot be verified — with a full refund of anything paid.

Licensing and compliance

Above Wines, LLC holds the applicable permits issued by the Texas Alcoholic Beverage Commission (TABC) and sells alcoholic beverages only as those permits allow. All sales are made, and title passes, in Texas. We reserve the right to limit quantities and to decline any order that we believe would violate TABC rules or any other applicable law.

Shipping

We ship wine only to addresses in jurisdictions where direct shipment to the recipient is lawful, via carriers licensed to transport alcohol. If your destination is not one of them, we will say so at checkout rather than guess. Orders over $199 ship free within our delivery area. Weather holds may delay shipment when heat would damage the wine; we think you would rather wait than drink cooked Nebbiolo.

Pricing and errors

Prices are in U.S. dollars, exclude applicable taxes unless stated, and may change without notice. Wine is an agricultural product: vintages roll, allocations end. If a listing contains an obvious error — a wrong price, a wrong vintage, stock we no longer have — we may cancel the affected order and refund it in full, which is the limit of our obligation for such errors.

Returns

A corked, flawed, or damaged-in-transit bottle will always be replaced or refunded — tell us within [TBD — claims window for Above Wines to set] and keep the bottle and remaining contents where practical. Because we sell alcohol, returns of sound, unopened wine are handled per our posted return policy and as Texas law permits; bring your receipt to the Irving shop or write to us and we will sort it out.

Limitation of liability

To the fullest extent permitted by law, Above Wines, LLC’s total liability arising from any order or from use of this site is limited to the amount you paid for the products at issue, and we are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited under applicable law. Please enjoy responsibly.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and any dispute will be brought in the courts of [TBD — venue for Above Wines to set], Texas.
